What is this settlement about?

This settlement arises from a class action lawsuit, Sims et al v. Mac Property Management, LLC et al, brought on behalf of people who lived in Building 4 or Building 5 at the Algonquin Apartments and were displaced by the outage that began on December 23, 2022. Shaunte Sims and Maxine Lathan filed a lawsuit in January 2023 claiming that Mac Property Management, LLC, and other Defendants, violated local and state laws by causing the heat and power outage in Buildings 4 and 5 of the Algonquin Apartments that displaced tenants in those buildings for about three weeks. Mac Property Management LLC and the other Defendants deny that they did anything wrong.

Settlement Status

In May 2024, the parties agreed to settle, which means that they have reached an agreement to resolve the lawsuit. The settlement is on behalf of the tenants who brought the case and all members of the settlement class. The Court has not decided this case in favor of either side. 

The Court granted preliminary approval of the Settlement Agreement on July 16, 2024. This means that people who believe they qualify as a Class Member may now submit a Claim Form.  

You must submit a Claim Form to obtain a settlement payment. Class Members have until October 5, 2024 to submit a Claim Form. The Court must give final approval to the settlement before it can take effect. Payments will only be made if the Court approves the settlement.

Who is included?

If you meet all of these criteria, you are eligible for a settlement payment. If you do not meet these criteria, you cannot receive a payment.

  • You were a party to a lease with Defendants for an apartment in Building 4 or Building 5 of the Algonquin Apartments (located at 1607 E 50thPlace and 1617 E 50th Place, Chicago, IL 60615) at any point between December 23, 2022 and January 13, 2023,
  • You were at least 18 years old as of December 23, 2022, and
  • You have not signed a release of claims or settlement with Defendants encompassing the outage at issue in this Litigation.
